4. Why do we need your express consent to use them?

The judgment of 1 October 2019 of the Grand Chamber or the Court of Justice of the European Union must be interpreted as meaning that consent is not validly given. When the storage of information or access to it, on the user’s terminal equipment on the website, through cookies is authorised by means of a ticked checkbox by default. The user must remove the tick in the event of preventing their use. In this sense the authorisation must be based on an explicit acceptance or an equal refusal by the user and other further information about the exposed cookies. This interpretation cannot change if the stored information or consulted in the user’s terminal of a place of Internet consists or not of personal data.

The Grand Chamber of the Court of Justice of the European Communities also states in this judgment that the information that the service provider must deliver to the user of a website on the Internet. This requirement is also set out in the amended version of Directive 2009/136 which changes Article 5, Part 3 of Directive 2002/58 EU and in the PDPA Guidance of July 2020.
